These Terms of Service (the “Terms”) govern the use of the website, user dashboard, and proxy services provided by SocksFive (the “Service”).
By using the Service, creating an account, or purchasing any Service, the User confirms that they have read and accepted these Terms.
If the User does not agree with these Terms, they must stop using the Service.
1. General Provisions
1.1. SocksFive provides Users with access to proxy infrastructure and related functionality according to the selected plan.
1.2. A User may be an individual with the legal capacity required to accept these Terms or an organization.
1.3. If the Service is used on behalf of an organization, the person using the Service represents that they have the necessary authority.
1.4. The price, duration, available traffic, speed and connection limits, available functionality, and other parameters of a particular Service are displayed on the website, in the user dashboard, or during checkout.
If the terms of a specific plan differ from the general provisions of these Terms, the expressly stated terms of that plan will apply to that Service.
2. Description of the Service
2.1. The Service provides the technical ability to route network connections through proxy infrastructure using supported protocols and authentication methods.

2.4. Users do not acquire ownership rights in any IP address, server, or other resource used to provide the Service.
3. Accounts and Security
3.1. Users are responsible for maintaining the confidentiality and security of their account credentials, passwords, proxy usernames, API keys, and other authentication information.
3.2. Activities performed using valid User credentials may be treated as activities performed by the User until SocksFive is notified that the relevant credentials have been compromised.
3.3. If unauthorized access is suspected, the User should change the affected credentials and, where appropriate, contact customer support.
3.4. Users may not sell, resell, or provide third parties with access to the Service unless this is expressly permitted by the applicable plan or a separate agreement.
3.5. Users are responsible for the activities of anyone to whom they provide access to their account or proxy credentials.
4. Characteristics of Proxy Infrastructure
4.1. A proxy network is dynamic infrastructure. Available IP addresses, servers, routes, and network operators may change over time.
4.2. Unless expressly guaranteed by the applicable plan, SocksFive does not guarantee:
4.3. Different geolocation services and network databases may identify the country, region, city, ASN, provider, or other characteristics of an IP address differently.
4.4. Connection speed, latency, and stability may depend on the User's location, proxy node, routing, Internet service providers, third-party networks, and the destination resource.
4.5. Third-party websites and services may independently restrict or block access from proxies, VPNs, particular IP addresses, or networks. Such restrictions do not, by themselves, constitute a defect in the Service.
5. Plans and Usage Accounting
5.1. SocksFive may offer plans limited by time, traffic volume, or other parameters.
Time-Based Plans
5.2. A plan purchased for a specified period provides access to the applicable Service during the paid period.
Failure to use the Service does not pause or extend the purchased period unless expressly stated otherwise in the applicable plan.
Traffic-Based Plans
5.3. For traffic-based plans: 1 GB = 1,000,000,000 bytes.
Unless otherwise specified by the applicable plan, traffic usage is calculated based on the total volume of data transferred through the Service in both directions.
5.4. Fixed-volume traffic plans do not expire until the purchased traffic volume has been consumed unless a different validity period is expressly stated at purchase.
5.5. Traffic and other usage statistics may be processed with a short technical delay. Active connections may continue after a limit is reached until those connections close, while new connections may be restricted after exhaustion of the available balance has been registered.
A minor technical difference between the displayed remaining balance and the actual volume processed does not constitute a failure to provide the Service.
5.6. Once an applicable limit has been exhausted, SocksFive may restrict new connections or access to the relevant Service until additional traffic or a new plan is purchased.
5.7. Bandwidth, concurrent connection, port, request-rate, and other technical limits are determined by the applicable plan.
Attempts to artificially circumvent such limits are prohibited.
6. Payments and Automatic Renewal
6.1. The applicable price is displayed before purchase on the website, in the user dashboard, or on the checkout page.
6.2. The User is responsible for selecting the correct plan and providing accurate payment information.
6.3. Independent payment providers may be used to process payments. Bank fees, payment-provider fees, blockchain network fees, currency conversion costs, and similar third-party charges may not be included in the price of the Service.
6.4. A Service is considered paid once payment has been confirmed by the applicable payment system and registered by SocksFive.
6.5. SocksFive may change prices for future purchases and renewals. Price changes do not apply retroactively to completed purchases.
6.6. Automatic renewal applies only where the User has enabled the feature or otherwise expressly agreed to recurring billing.
6.7. When automatic renewal is enabled, the User authorizes the applicable payment method to be charged for the next service period.
6.8. The User may disable automatic renewal before the next charge through the available account settings.
6.9. If a renewal payment fails, the applicable Service may be suspended or terminated after the already-paid period expires.
7. Acceptable Use
7.1. Users must use the Service only for lawful purposes and are solely responsible for activities performed through the proxy infrastructure.
7.2. The Service must not be used for:
7.3. Automated access, collection of publicly available information, and the use of automated tools are not prohibited by these Terms merely because they are automated. The User is responsible for ensuring that the specific activity complies with applicable requirements and third-party rights.
7.4. The User is solely responsible for the websites, applications, data, and other resources accessed through the Service.
8. Abuse Investigation and Access Restrictions
8.1. SocksFive may temporarily restrict or suspend an account, subscription, proxy access, port, destination, or other functionality where there are reasonable grounds to believe that:
8.2. Where there is an immediate risk to security, infrastructure, or third parties, restrictions may be imposed without prior notice.
8.3. SocksFive may request information reasonably necessary to investigate suspected abuse or a disputed transaction.
8.4. Where the cause of a restriction has been resolved, access may be restored.
8.5. Serious or repeated violations may result in termination of the applicable Service and closure of the account.
9. Refunds
9.1. Unless expressly stated otherwise at the time of purchase, payments for activated or already-used Services are non-refundable, except where a refund is required by applicable mandatory requirements or where a material technical inability to provide the purchased Service is verified and is attributable to circumstances under the control of SocksFive.
9.2. Characteristics inherent in dynamic proxy infrastructure described in Section 4, including an IP being blocked by a third-party website, changes in IP reputation, differences between geolocation databases, or inability to access a particular third-party resource, do not by themselves constitute grounds for a refund.
Failure to use a purchased Service, incorrect configuration of the User's software, or changes to the rules or security systems of a third-party website or service do not by themselves constitute grounds for a refund.
9.3. Users may contact customer support regarding verified duplicate or erroneous charges.
9.4. Where a Service is terminated because of a serious violation of these Terms, unused time or remaining Service is non-refundable except where otherwise required by applicable mandatory requirements.
9.5. SocksFive may, at its discretion, provide a refund, additional service time, additional traffic, or service credit to resolve a verified technical issue.
10. Third-Party Infrastructure
10.1. SocksFive may use its own infrastructure as well as servers, networks, IP resources, and technologies operated by independent providers.
10.2. The User may not require that a connection be served by a particular provider, server, network, or route unless this is expressly included in the purchased plan.
10.3. Infrastructure providers may change without requiring an amendment to these Terms.
10.4. Certain features, geographic locations, networks, or IP resources may temporarily become unavailable due to technical limitations, security requirements, actions of telecommunications providers, or restrictions imposed by an infrastructure provider.
11. Service Availability
11.1. To the maximum extent permitted by applicable requirements, the Service is provided on an “as is” and “as available” basis.
11.2. SocksFive uses reasonable efforts to maintain its infrastructure but does not guarantee completely uninterrupted or error-free operation.
11.3. Maintenance, updates, incidents, network failures, DDoS attacks, actions of telecommunications providers, data centers, and other third parties may result in temporary unavailability of certain functions.
11.4. Unless a specific Service Level Agreement is expressly included with a particular plan, no specific uptime percentage is guaranteed.
11.5. SocksFive does not guarantee that use of the proxy infrastructure will produce any particular commercial, technical, or other result.
12. Limitation of Liability
12.1. The User is solely responsible for the legality and consequences of activities carried out using the User's account and proxy access.
12.2. To the maximum extent permitted by applicable requirements, SocksFive is not liable for:

Where liability cannot be fully excluded, the aggregate liability of SocksFive for a claim relating to a particular paid Service will not exceed the amount actually paid by the User for that Service during the three months preceding the event giving rise to the claim, unless a higher limit is required by applicable mandatory requirements.
12.4. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
13. User Responsibility for Third-Party Claims
To the extent permitted by applicable requirements, the User is responsible for valid third-party claims arising directly from the User's unlawful use of the Service or a material violation of these Terms.
14. Intellectual Property
14.1. The website, software, interface, API, documentation, design, and other elements of SocksFive belong to their respective rights holders.
14.2. The User receives a limited right to use the functionality of the Service solely for the purpose of accessing purchased Services.
14.3. The User may not copy, decompile, modify, or use the software components of SocksFive to create a competing product, except where such restriction is prohibited by applicable requirements.
15. Privacy and Account Deletion
15.1. Information relating to use of the website, account, and proxy services is processed in accordance with the SocksFive Privacy Policy.
15.2. SocksFive does not inspect, analyze, or store the content of traffic transmitted by the User through proxy connections.
15.3. Users may delete their account using the available account deletion function or by contacting customer support.
After an account is deleted, all User information associated with the account and stored by SocksFive is deleted in accordance with the Privacy Policy. Once deletion is completed, the account and its associated information cannot be restored.
15.4. Deleting an account terminates access to Services, subscriptions, and remaining traffic associated with that account and does not, by itself, create a right to a refund.
16. Termination of the Service
16.1. Users may stop using the Service at any time.
16.2. SocksFive may discontinue a particular Service or feature.
Where such discontinuation materially affects an already-paid Service of a User who is not in violation of these Terms, SocksFive may provide a proportional refund, service credit, or replacement for the part of the Service that can no longer be provided.
16.3. Provisions of these Terms that by their nature should survive termination will remain effective after use of the Service ends.
17. Changes to These Terms
17.1. SocksFive may update these Terms from time to time as its functionality, infrastructure, payment methods, security policies, or applicable requirements change.
17.2. The current version of these Terms will be published on the website together with the date of the latest update.
17.3. Material changes may also be communicated through the website, user dashboard, or other available communication channels.
17.4. Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable requirements.
18. Dispute Resolution and Miscellaneous
18.1. If a dispute or complaint arises, Users are encouraged to contact SocksFive customer support first so that the matter may be reviewed and, where possible, resolved.
18.2. If a dispute cannot be resolved directly between the parties, it will be handled in accordance with applicable mandatory requirements and the rules governing the competent authority or court.
18.3. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain effective to the maximum extent permitted.
18.4. Failure by SocksFive to enforce a right in a particular instance does not constitute a waiver of that right.
18.5. These Terms may be published in multiple languages. All language versions are intended to convey the same meaning. In the event of a material inconsistency, the English version will prevail unless SocksFive expressly states otherwise.
